Long-Term Disability (LTD) insurance protects policy holders from financial loss in the event of a disability caused by an injury or sickness. Most LTD insurance policies obtained through employment are governed by ERISA. Policies obtained through a broker or independently from work are known as individual disability policies. Marcus has extensively lectured on LTD insurance topics including the ERISA component of the Florida Bar Labor and Employment Law board certification review course. Marcus currently focuses his LTD insurance claim practice on counseling and representing professionals and business owners pursuing an individual disability LTD claim or case.
Long-Term Disability Insurance Claims Case Studies
Over the course of two decades Marcus has successfully resolved hundreds of LTD insurance claims on behalf of clients. While most LTD insurance cases are resolved by settlement some cases do go to court. The following are two case victory examples:
Migliaro v. IBM Long-Term Disability Plan: Despite the carrier’s efforts to derail the claim using paid experts to conduct an “independent” medical examination and functional capacity evaluation as well as taking surveillance video, Marcus successfully thwarted the games and obtained substantial benefits on his client’s behalf.
Smith v. Home Depot Welfare Benefits Plan: The carrier in this case tried to derail the case based on a stretched interpretation of policy exclusions. Marcus defeated this defense and convinced a federal judge to award benefits in his client’s favor.
