As one of the first labor and employment law attorneys certified by The Florida Bar, Marcus has extensive experience handling a wide spectrum of cases in this practice area. Representing both plaintiffs and defendants, Marcus has achieved jury trial victories in cases involving allegations of discrimination, harassment and retaliation. His litigation experience helps him counsel clients to avoid employment liability. In addition to Title VII and Florida Civil Rights Act claims, Marcus has also handled and tried wage and overtime claims including those governed by the Fair Labor Standards Act.
For Employers
Many employee issues can be avoided before they even occur with litigation avoidance planning. Fundamental HR practices include implementing and revising employee handbooks and rules of conduct, leave of absence systems, EEO compliance training and the like. Marcus has instituted these systems and trained business owners and supervisors in best practices for years. Inevitably employee issues will arise and we are available for counseling and problem solving on short notice.
Sometimes claims are inevitable. Marcus has represented employers in a variety of pre-suit agency proceedings. These include submissions of position statements to the EEOC as well as complaint responses to the NLRB and Department of Labor.
Litigation defense is also sometimes necessary. Marcus has extensive experience handling employer defense cases for both public and private clients. One thing setting him apart from most other attorneys is his insight into jury dynamics gained from his trial consulting work. Also unlike many other trial attorneys Marcus provides litigation case budgets to avoid unnecessary client sticker shock.
For Employees
Marcus represents employees on a selective basis in employment litigation. Over the course of his career, he has favorably resolved cases under the Americans with Disabilities Act, Family and Medical Leave Act, Fair Labors Standards Act, Title VII, USERRA, ADEA and the Florida Civil Rights Act. Marcus has a particular interest in private sector whistleblower cases. To learn more about this unique area of the law you can download our Whistleblower Law eBook.
